THE CHANGE OF THE BASIC LAW FOR THE FEDERAL REPUBLIC OF GERMANY FROM THE 22ND MARCH 2025 AS AN EXAMPLE OF THE COMMUNITY OF EXPERIENCES OF THE EUROPEAN COUNTRIES

This article is focused on the change of the Basic Law for the Federal Republic of Germany and the proposal of changing The Constitution of the Republic of Poland, which are both compared in order to answer whether these two changes (treated as wholes) are motivated by the same or, at least, similar circumstances and in effect create a community of experiences. Firstly, the article analyzes the amendment to the German Basic Law, which stipulates that the amount allocated to defence, civil and population protection, intelligence services, the protection of information systems and assistance to countries attacked in violation of international law, which exceeds 1% of nominal GDP, is subject to a permissible deduction from credit income, which must be taken into account. Secondly, the chapter analyzes the case of Poland, where an initiative has been taken to establish a minimum amount (4% of gross domestic product) in the Polish Constitution, which would be allocated in the budget law to finance the defence needs of the Republic of Poland.
