ARTIFICIAL INTELLIGENCE IN EDUCATION – OPPORTUNITIES, THREATS, LEGAL FRAMEWORK
The subject of this paper is an analysis of selected issues concerning the application of artificial intelligence in education, the opportunities arising therefrom, as well as proposals for an EU legal framework in response to potential threats. Artificial intelligence systems can play an important role in the modernization of education, leading to an improvement in the quality of education and making it more accessible to the public. They can also foster social inclusion, particularly in the education of people from smaller towns, people with disabilities or otherwise being at risk of exclusion. At the same time, the use of artificial intelligence and data may have a negative impact on a number of fundamental rights enshrined in the Charter of Fundamental Rights of the European Union. Proposed regulations at the European Union level aim to address various sources of risk and guarantee a high level of protection of fundamental rights against AI systems. This is particularly served by a set of requirements for reliable artificial intelligence and proportionate obligations imposed on all participants concerned. The proposed regulations may generate a burden for schools, which will struggle to master the application of new technologies in the educational process on the one hand, and to fulfill numerous legal obligations on the other.
